TERMS & CONDITIONS
Introduction
a. The Bzaar software Application and website at https://order.networkgrey.co.za (the “App”) is available for download from various App stores identified by Bzaar from time to time, on compatible electronic devices, or accessible through the website. The App is owned and operated by Network Grey (Proprietary) Limited (“Bzaar”, “we”, “us” and “our”).
b. The App enables users to order and purchase Goods, food, beverages, groceries, services and other items (the “Goods”) from any of the Shops, grocery stores, retail outlets, liquor stores, pharmacies or other outlets listed on the App (each a “Shop”).
c. These terms and conditions (“Terms and Conditions”) govern the ordering, sale, delivery and collection of Goods, and the use of the App. These Terms and Conditions are binding and enforceable against every person that accesses or uses the App (“you”, “your” or “user”), including without limitation each user who registers as contemplated below (“registered user”). By using the App, you acknowledge that you have read and agree to be bound by these Terms and Conditions. You must not use the App or Telephone Service if you disagree with the Terms and Conditions.
- Definitions
a. In these Terms and Conditions, the following definitions Apply:
i. “App” refers to the following Bzaar mobile Applications: the Shopping App, Partner App and Driver App, collectively or individual.
ii. “Vendor”, “Restaurant”, “Shop(s)”, “Merchant” or “Service Provider” refers to any business listed on Bzaar selling food, Goods or services.
iii. “User” or “You” refers to the person using the Bzaar App to purchase Goods or services.
iv. “Courier” refers to third-party service providers who deliver Goods ordered via the Bzaar App. - Order Placement
a. When you place an order via the Bzaar App, you acknowledge that you’re entering into a direct agreement with the Shop from which the Goods are purchased. The sale of Goods (formed upon acceptance of your order) is solely between you and the relevant Shop. Neither Bzaar nor any party involved in the courier delivery (if Applicable) is a party to this sale. Bzaar provides the platform to facilitate transactions between you and the Shop. We are neither the buyer nor the seller of the Goods. - Important Notice
a. These Terms and Conditions Apply to users who are consumers for purposes of the Consumer Protection Act 2008 (the “CPA”).
b. These Terms and Conditions contain provisions that Appear in similar text and style to this clause and which:
i. May limit the risk or liability of Bzaar or a third party; and/or
ii. May create risk or liability for the user; and/or
iii. May compel the user to indemnify Bzaar or a third party; and/or
iv. Serve as an acknowledgement, by the user, of a fact. - You are drawn to these Terms and Conditions because they are important and should be carefully noted. If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask Bzaar to explain it to you before you accept the Terms and Conditions by continuing to use the App.
- Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or Bzaar in terms of the CPA.
- Our Process
a. You may order Goods via the App. At the time of ordering, you are required to indicate your address, and then you will be given a selection of Shop. You will only be allowed to order Goods from that selection of Shop, which fall within the prescribed area (as determined by Bzaar from time to time) surrounding your given address.
b. Where you have ordered using the App, you may be given the choice of receiving the Goods using courier, which delivery service shall be carried out either (i) by Bzaar or its nominee, or (ii) by a driver whom you mandate to deliver Goods on our platform (“Driver”) (items (i) and (ii) collectively referred to as the “Courier Delivery”), or using self-collection by you or your nominee from the relevant Shop (“Self-collection”). Where no choice is given for a Courier Delivery, you can order Goods on the App for Self-collection.
c. We will indicate on the relevant product and checkout pages in the App which Goods items are for sale by a particular Shop. You can only order Goods from one Shop at a time, in each order placed.
d. You can only place orders for Goods from a Shop if it is open for business and active on the App. You may only place orders for liquor products during the hours permitted by law. We may at any time suspend or terminate the availability of a Shop, menu or menu item on the App at our sole discretion.
e. You acknowledge that, notwithstanding the Goods may be ordered via the App, you place such an order with the relevant Shop. The sale of Goods (formed on acceptance of an order) is solely between the registered user and the relevant Shop.
f. Neither Bzaar nor any party attending to the Courier Delivery (if Applicable) is a party to that sale of Goods. Bzaar only provides the platform to facilitate transactions between Shop and registered users of the Goods. Bzaar is neither the buyer nor the seller of the Goods.
g. Any claims the registered user may have in respect of the Goods shall be against the relevant Shop.
h. Because we want you to have a safe and consistent experience, Bzaar will be your first point of contact for any complaints arising out of or in connection with the sale of Goods between a registered user and a Shop. Should such a complaint escalate into a dispute, although Bzaar is entitled to become involved in an attempt to resolve it, Bzaar is not obliged to do so and any disputes must be resolved between the registered user and the relevant Shop. - Registration and use of the App
a. Only registered users may order Goods via the App.
b. To register as a user via the App, you must provide Bzaar with your unique email address or telephone number, personal details and any other relevant information required. You will be requested to select your password or be issued a randomly generated password (which you may subsequently change).
c. You will need to use your unique username and password to place an order via the App. You agree that a Bzaar operator may call you to confirm your details, order information and amount owed. For security purposes, you agree to enter your correct username and password whenever ordering Goods via the App, failing which we will not process your order.
d. You agree and warrant that your username and password (if Applicable) shall not be disclosed by you to any third party.
e. You agree that, once your correct username and password have been entered (about the App), irrespective of whether the use of the username and/or password is unauthorised or fraudulent, you will be liable for payment of any resulting order.
f. You agree to notify Bzaar immediately upon becoming aware of or reasonably suspecting any unauthorised access to or use of your username and/or password and to take steps to minimise any resultant loss or harm.
g. You agree that you will not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the App. You may use the App only for lawful purposes and may not in any way (including without limitation by use of any robot, spider, other automatic device or manual process) monitor, distribute, display, publish, copy, print, post, modify or otherwise use the App and/or the information contained therein without the express prior written consent of an authorised Bzaar representative. - Conclusion of Sales and Availability of Goods
a. Registered users may place orders for Goods, which the Shop and/or Bzaar may accept or reject. The placing of an order will hAppen when payment is made by any of the acceptable payment methods mentioned below and is confirmed on the App. Whether or not the Shop and/or Bzaar accepts an order depends on various factors, including but not limited to, the availability of Goods, capacity for Courier Delivery, correctness of the information relating to the Goods (such as the price) and receipt of payment or payment authorisation (if Applicable) by Bzaar for the Goods.
b. Bzaar charges each Shop a commission based on the value of the Goods ordered on the App. Menu pricing on the App is set at the discretion of each Shop and may differ from the in-store menu pricing or prices on other Apps.
c. NOTE: Bzaar will indicate the acceptance of your order (by Bzaar and the Shop) by way of notification on the App or email (“Acceptance Notice”), and only at that point will agreements of sale (the “Sale”) come into effect between you and the Shop in respect of the Goods; and if Applicable, Bzaar in respect of the Courier Delivery services (if you requested Courier Delivery of the Goods). This is regardless of any earlier communication from the Shop and/or Bzaar stating that your order or payment has been confirmed.
d. Bzaar will indicate the rejection of your order by cancelling it, notifying you thereof and credit your Credit Wallet, for the amount you already paid. You can then use this credit either immediately or at a later date when you place your next order with Bzaar. Should you wish to have a refund, please refer to the FAQ section.
e. Before the Goods are delivered to your nominated address or you are notified that the Goods is ready for collection (as Applicable), we may reject an order or cancel a Sale at any time due to: (i) the Shop being unable to fulfil the order; (ii) Courier/Delivery services not being readily available (if Applicable); and/or (iii) any other reason in Bzaar’s sole discretion.
f. Should you wish to retract your order, you should contact Bzaar via telephone immediately, and Bzaar will use its reasonable endeavours to effect such retraction. You will not be able to retract your order via the App, or after an Acceptance Notice has been generated. You will not be able to change your order after placing it but may be able to retract it (subject to the above) and place a new one.
g. Placing Goods in your Shopping basket on the App without completing the purchase cycle does not constitute an order for Goods, and as such, Goods may be removed from the Shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold Bzaar and/or the Shop liable if such Goods are not available or are not available at a particular price when you complete or attempt to complete the purchase cycle at a later stage.
h. Bzaar relies on information supplied to it by the Shop relating to the Goods, and Bzaar accordingly bears no liability for any inaccuracies in such information supplied to it. You acknowledge that stock of all Goods on offer may be limited. Bzaar will make reasonable efforts to ensure that when Goods are no longer available, offers thereof are discontinued on the App. However, we cannot guarantee the availability of Goods. When Goods are no longer available after you have placed an order or the Shop does not accept your order, Bzaar will notify you thereof and reject your order or cancel the Sale (“Failed Order”).
i. Bzaar will credit your Credit Wallet for the amount you paid in respect of the Failed Order. You can use this credit either immediately or at a later date when you place your next order with Bzaar.
j. Should you wish to have a refund of the amount in your Credit Wallet, please refer to the FAQ.
k. You also acknowledge that the pricing of Goods may change at any time without notice to you, but no price change will affect any Goods ordered in respect of which you have received an Acceptance Notice, except in the case of an obvious pricing error. In the event of an obvious pricing error, we may reject your order or cancel the Sale at any time and you will be entitled to a refund of the amount paid by you for such order.
l. Any dispute regarding inaccurate information relating to a Shop or Goods, Goods pricing errors or sold-out Goods should be resolved between you and the relevant Shop; your respective rights and obligations being as set out in these Terms and Conditions.
m. It is your responsibility to establish from the relevant Shop which ingredients will be used when preparing the Goods and make the necessary arrangements with such Shop to exclude any ingredients if you have any allergies or special requirements (unless such exclusions can be made by you on the App). We cannot and do not guarantee that the Goods will be free of allergens and we disclaim any liability relating to any ingredients or allergens contained in Goods. - Cancellation Policy
a. If you wish to cancel your order after the Shop has accepted it, you must reach out to our support team immediately telephonically. This option will Appear when your order is live. Our support team will then contact the Shop to confirm the cancellation. Please be aware that if the restaurant or Shop has started preparing your order, we may not be able to cancel it without incurring a charge. Bzaar will assist with cancellations, but any disputes regarding this process should be resolved between you and the vendor. - Refund Policy
a. You acknowledge that, while Bzaar facilitates transactions between you and the relevant vendor, any claims for refunds must be directed to the vendor from whom the Goods were purchased. Because we want you to have a safe and consistent experience, Bzaar will be your first point of contact for any complaints arising out of or in connection with the sale of Goods between you and the vendor. We will assist in resolving the issue, but refunds are ultimately managed by the vendor. Refunds may be granted in cases of incorrect, incomplete, or unsatisfactory orders, subject to the vendor’s policies. Due to the nature of prepared food, refunds may be limited or not possible if the order is delivered as requested. - Return Policy
a. Since the Goods sold on Bzaar include prepared food, returns are generally not feasible. The sale of food is final once delivered unless there is a significant issue with the order, such as receiving the wrong items. Because we want you to have a safe and consistent experience, Bzaar will be your first point of contact for any complaints related to the quality or accuracy of the order. While we will assist in resolving such matters, if the complaint escalates into a dispute, it must be resolved between you and the vendor. Bzaar is entitled to become involved to help resolve the dispute but is not obliged to do so. - Dispute Resolution
a. In case of any disputes regarding the Goods or service provided, your first point of contact will always be the vendor from whom the Goods or service was purchased. Bzaar will assist in resolving the matter and act as an intermediary between you and the vendor. However, Bzaar is not responsible for the quality or preparation of the food or Goods, and any claims must be addressed to the vendor directly. Should such a complaint escalate into a dispute, Bzaar may become involved to help resolve it but is not obliged to do so. The final resolution must be achieved between you and the vendor. - Delivery
a. Bzaar facilitates the delivery of Goods by coordinating with third-party couriers. While we aim to ensure that deliveries are timely and accurate, the responsibility for the preparation and quality of the Goods lies solely with the Shop. Any issues with the Goods received should be directed to the Shop, with Bzaar assisting where possible. - Limitation of Liability
a. Bzaar shall not be liable for any damages, losses, or expenses arising from the use of the App, the inability to use the App, or the failure to deliver Goods as requested. This limitation of liability Applies to any indirect, incidental, consequential, or punitive damages, even if Bzaar has been advised of the possibility of such damages. - Amendments to Terms and Conditions
a. Bzaar reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is your responsibility to review these Terms and Conditions regularly to ensure you are aware of any changes. - Governing Law
a. These Terms and Conditions are governed by and construed in accordance with the laws of South Africa, and any disputes relating to these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of South Africa. - Minors, liquor and vaping products
a. By using the App you warrant that you are 18 years of age or older and in full legal capacity. If you are under the age of 18 or if you are not legally permitted to enter into a binding agreement, then you may use the App only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then he/she agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.
b. Shops may not sell liquor or vaping products to you if you are under the age of 18 (regardless of any supervision by a parent or guardian). You may be requested to provide proof of your age before receiving any liquor or vaping products ordered via the App. The Courier Delivery or Self-collection of any liquor or vaping products may be refused and you will be held liable for all charges relating to such order, should you fail to provide adequate proof that you are 18 years of age or older, or if you Appear to be under the influence of drugs or alcohol at the time of delivery or collection of such products. - Conclusion of Sales and Availability of Goods
a. For each order, you will be charged the total Goods price by the relevant Shop; where you have selected Courier Delivery, a Courier Delivery fee by Bzaar, alternatively a driver fee by the Driver; and where you have ordered from certain Shop as indicated on the App, a personal Shopper fee by Bzaar may be charged in addition to the Courier Delivery fee, or a driver fee by the Driver (as the case may be), where such charges are as reflected on the App at the time you place the order (together, the “order charges”).
b. If specifically requested by you, Bzaar will provide you with a valid invoice for any fees charged by it or the Driver (as the case may be) in respect of the Courier Delivery. The invoice will be sent to you by email and will also reflect the price of the purchased Goods as a line item. Please contact the relevant Shop directly if you require a valid invoice in respect of the purchased Goods. If any Shop fails to provide you with the invoice within 5 business days after your request, you may notify us thereof and we will endeavour to obtain and provide you with the required invoice as soon as possible. - Payment
a. Bzaar will receive payment of all order charges and will pay the Goods-related portion thereof to the relevant Shop. We are authorised to receive payment for the Goods on behalf of the Shop and payment made by you to us for the full price of the Goods will discharge your payment obligations to the Shop.
b. If a Driver is used under a Courier Deliver, Bzaar will receive payment and will pay the delivery-related portion thereof to the relevant Driver. We are authorised to receive payment for the delivery of Goods on behalf of the Driver and payment made by you to us for the price of the delivery will discharge your payment obligation to the Driver.
c. Payment for your order can be made in one of the following ways (only one payment method may be used to settle the amount due and not a combination of payment methods:
i. Credit Card Payment: by credit card may only be made when an order is placed via the App. Where payment is made by credit card, we may require additional information to authorise and/or verify the validity of payment. You will be redirected to the secure site of our payment gateway, which is not owned by Bzaar or under Bzaar’s control, and for which you acknowledge Bzaar is not responsible in law. Such payment gateway is however committed to upholding strict security standards, and at no stage will Bzaar store your credit card details (save for the last four digits for payment purposes). We are entitled to withhold processing the order until the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation, your order for the Goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the order charges. You also warrant that your credit card has sufficient available funds to cover all the order charges; and
ii. Cash on delivery: Cash payments may only be made to Bzaar or its nominee upon receipt of the Goods using Courier Delivery (not Self-collection). By selecting this option, you undertake to ensure that you have sufficient cash on hand at the time of delivery to cover the order charges.
iii. Instant EFT: Where payment is made by EFT, we may require additional information to authorise and/or verify the validity of payment. You will be redirected to the secure site of our payment gateway, which is not owned by Bzaar or under Bzaar’s control, and for which you acknowledge Bzaar is not responsible in law. Such payment gateway is however committed to upholding strict security standards, and at no stage will Bzaar store your banking details. - We are entitled to withhold processing the order until the relevant information is received by us and authorisation is obtained by us for the transaction. If we do not receive authorisation, your order for the Goods will be cancelled. You warrant that you are fully authorised to use the bank details supplied for purposes of paying the order charges. You also warrant that your bank account has sufficient available funds to cover all the order charges;
iv. Credit Wallet: Please refer to our FAQ for more details on this payment option.
d. If you have a promotional coupon or discount (“Coupon”) that you wish to use with your order, you may only do so via the App.
e. The above payment options are explained in more detail in our FAQ section, which is incorporated by reference (which means that it is deemed to form part of these Terms and Conditions). - Delivery of Goods
a. If you order Goods for Courier Delivery by Bzaar or its nominee, an independent contractor or Driver) (the “Courier”):(i) you are required to indicate the physical address to which the Goods should be delivered (“Delivery Address”); (ii) you are not allowed to change the Delivery Address after submitting your order; and (iii) you will only be allowed to order Goods from Shop within the prescribed range (as determined by Bzaar) from your Delivery Address.
i. If you order Goods for Self-collection: (i) you should indicate a physical address, for Bzaar to provide you with a selection of Shop in such an area; and (ii) you will only be allowed to order Goods from such Shop.
b. Where you have requested the Goods to be delivered to you by way of Courier Delivery and you have received an Acceptance Notice:
c. The courier will endeavour to deliver the Goods to you by the estimated delivery time specified in the Acceptance Notice, however, delivery times are not guaranteed and may be adjusted by us at our reasonable discretion. Events outside of the Courier’s control such as traffic, inclement weather conditions and delays by the Shop about your order may result in a delay in the delivery of the Goods, but the Courier will continue with its efforts to deliver the Goods to you as soon as possible in the circumstances; and
d. Our obligation to deliver the Goods is fulfilled when the Courier delivers the Goods to the Delivery Address. The Courier is only responsible for the delivery of the Goods to the Delivery Address. If the Courier arrives at the Delivery Address and you fail to open the door or respond to its telephone calls within 10 minutes, the Courier may leave the premises, taking the Goods with it, and you will remain liable for payment of all order charges.
e. If you are not able to be present at the Delivery Address to accept the delivery of the Goods, it is your responsibility to arrange for someone else to accept the delivery at such address and pay for the order on your behalf if payment has not yet been made. Neither Bzaar nor the Shop is responsible for any loss or unauthorised consumption of Goods after the Courier has delivered the Goods to the Delivery Address.
f. Where you have ordered Goods for Self-collection from the Shop and you have received an Acceptance Notice: you or your nominee should display a copy of the Acceptance Notice to the Shop upon collection of the Goods; and
g. The Shop is responsible for making the Goods available for collection by you or your nominee at its premises, at the estimated collection time set out in the Acceptance Notice. If you or your nominee fails to collect the Goods or respond to our or the Shop’s telephone calls, within 60 minutes after the estimated collection time, the Shop may dispose of the Goods in any manner which it deems fit and you will remain liable for payment of the Goods.
h. Any dispute regarding the Shop failing to make the Goods available at the collection time or within 60 minutes thereafter, should be resolved between you and the relevant Shop; your respective rights and obligations being as set out in these Terms and Conditions.

a. We shall make all reasonable efforts to accurately reflect or inform you of the Goods description, availability, purchase price and Courier Delivery service charges via the App. However, should there be any errors of whatsoever nature on the App (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to an order or Sale based on any error, the rejection of an order or the cancellation of a Sale, save to the extent of refunding you for any amount already paid. - Complaints
a. We want you to be happy with your purchase. Please let us know by telephone or email as soon as possible if there is a problem with your Goods quality or if you receive the wrong Goods or if you receive Goods which are not as described on the App.
b. Save where we determine in our sole discretion that the cause for the complaint was due to the fault of the Shop, we will communicate your complaint to the relevant Shop, and thereafter the matter will need to be resolved by the parties to the Sale of Goods, being you and the Shop, and Bzaar shall bear no liability about such complaint. Bzaar may in its sole and absolute discretion provide you with the compensatory amount in your Credit Wallet
c. If we are unable to resolve your complaint to your satisfaction or we cannot resolve your complaint to your satisfaction, you can Approach the Consumer Goods and Services Ombud (“CGSO”) to assist in resolving the complaint. a. Bzaar may from time to time make Coupons available for use on the App towards the purchase of Goods. Coupons can only be redeemed while they are valid and their expiry dates cannot be extended.
b. Coupons are issued at Bzaar’s sole discretion and we are entitled at any time to correct, cancel or reject a Coupon for any reason. Users do not have a right to Coupons, and Coupons cannot be earned. Coupons are issued under specific terms and conditions regulating when and how they may be used.
c. Unless otherwise stated under the specific terms and conditions regulating the Coupon:
i. Each coupon can only be used once or multiple times as per the Coupon campaign terms and conditions;
ii. only one Coupon can be used per order.
iii. only one Coupon can be used per person per promotion/campaign on the App;
iv. A coupon must be used at check-out – it cannot be used later on existing orders.
v. Coupons with a percentage discount offer may only be redeemed on purchases with a total cart value of less than R3000; and
vi. the value of the Coupon will be set off against the value of your Shopping basket and the balance remaining, if any, will be payable by you.
d. Coupons cannot be used to buy other Coupons and cannot be exchanged or refunded for cash or credit. However, if you use a Coupon and your order is rejected or your Sale is cancelled, your Coupon will be made available for use again.
e. Bzaar is not responsible for any loss or unauthorised use of a Coupon. - Disclaimer
a. The services are provided “as is” and “as available.” Bzaar disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
b. In addition, Bzaar makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the services or any services or Goods requested through the use of the services, or that the services will be uninterrupted or error-free. Bzaar does not guarantee the quality, suitability, safety, or ability of third-party providers.
c. You agree that the entire risk arising out of your use of the services, and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under Applicable law. - Limitation of Liability.
a. Bzaar shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services, even if Bzaar has been advised of the possibility of such damages.
b. Bzaar shall not be liable for any damages, liability, or losses arising out of: (i) your use of or reliance on the services or your inability to access or use the services; or (ii) any transaction or relationship between you and any third-party provider, even if Bzaar has been advised of the possibility of such damages.
c. Bzaar shall not be liable for delay or failure in performance resulting from causes beyond Bzaar’s reasonable control.
d. You acknowledge that third-party transportation providers offering transportation services through some request brands may provide ridesharing or peer-to-peer transportation services and may not be professionally licensed or permitted.
e. In no event shall Bzaar’s total liability to you in connection with the services for all damages, losses, and causes of action exceed one thousand Rand (R1000).
f. Bzaar’s services may be used by you to request and schedule transportation, Goods, or logistics services with third-party providers, but you agree that Bzaar has no responsibility or liability to you related to any transportation, Goods, or logistics services provided to you by third-party providers other than as expressly set forth in these terms.
g. The limitations and disclaimer in this section do not purport to limit liability or alter your rights as a consumer that cannot be excluded under Applicable law. - Indemnity
a. You agree to indemnify and hold Bzaar and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (i) your use of the Services or services or Goods obtained through your use of the Services; (ii) your breach or violation of any of these Terms; (iii) Bzaar’s use of your User Content; or (iv) your violation of the rights of any third party, including Third Party Providers. - General
a. You may not assign or transfer these Terms in whole or in part without Bzaar’s prior written Approval. You give your Approval to Bzaar for it to assign or transfer these Terms in whole or in part, including to (i) a subsidiary or affiliate; (ii) an acquirer of Bzaar’s equity, business or assets; or (iii) a successor by merger. No joint venture, partnership, employment or agency relationship exists between you, Bzaar or any Third-Party Provider as a result of the contract between you and Bzaar or use of the Services.
b. If any provision of these Terms is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms but the legality, validity and enforceability of the other provisions in these Terms shall not be affected. In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms.
c. These Terms constitute the entire agreement and understanding of the parties concerning its subject matter and replace and supersede all prior or contemporaneous agreements or undertakings regarding such subject matter. In these Terms, the words “including” and “include” mean “including, but not limited to.”
d. Bzaar accepts South African Rand (ZAR) as the only legal currency for tender.

These Terms and Conditions are governed by and construed in accordance with the laws of South Africa, and any disputes relating to these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of South Africa.
